1. Agreement to Terms

By accessing and using Playenda yacht charter services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Playenda provides luxury yacht charter services including but not limited to:

• Yacht rentals for recreational purposes
• Event hosting on yachts
• Professional captain and crew services
• Custom route planning and maritime experiences

3. Booking and Payment Terms

3.1 Reservations

All yacht charter bookings require advance reservation and are subject to availability. Reservations are confirmed only upon receipt of required deposit and signed charter agreement.

3.2 Payment Schedule

• A deposit of 50% of the total charter fee is required to confirm booking
• Full payment is due 72 hours prior to charter departure
• Additional services and gratuities may be paid on the day of service

3.3 Accepted Payment Methods

We accept major credit cards, bank transfers, and certified checks. All payments must be in Canadian dollars unless otherwise agreed upon in writing.

4. Cancellation and Refund Policy

4.1 Client Cancellations

• More than 14 days before charter: Full refund minus 10% processing fee
• 7-14 days before charter: 50% refund
• 3-7 days before charter: 25% refund
• Less than 72 hours: No refund unless rescheduled

4.2 Weather Cancellations

If Playenda determines that weather conditions are unsafe for charter operations, clients may reschedule at no additional cost or receive a full refund.

4.3 Playenda Cancellations

In the unlikely event that Playenda must cancel a charter due to mechanical issues or other circumstances beyond our control, clients will receive a full refund or the option to reschedule.

5. Safety and Conduct

5.1 Safety Requirements

• All passengers must attend mandatory safety briefing before departure
• Life jackets must be worn when required by captain or crew
• Swimming is permitted only in designated areas and with captain approval
• Passengers must follow all safety instructions from crew members

5.2 Prohibited Activities

• Illegal drug use or excessive alcohol consumption
• Smoking in enclosed areas of the vessel
• Bringing aboard prohibited items including firearms
• Disorderly conduct that endangers passengers or crew

5.3 Captain's Authority

The captain has ultimate authority over the vessel and all persons aboard. Passengers who fail to comply with safety instructions or engage in inappropriate behavior may be removed from the charter without refund.

6. Liability and Insurance

6.1 Limitation of Liability

Playenda's liability for any claim arising from yacht charter services is limited to the amount paid for the charter. We are not liable for indirect, special, or consequential damages.

6.2 Passenger Responsibilities

Passengers charter at their own risk and are responsible for their personal safety and belongings. Playenda is not responsible for loss or damage to personal property.

6.3 Insurance Coverage

All Playenda vessels carry comprehensive marine insurance. Passengers are encouraged to obtain travel insurance for personal coverage.

7. Health and Medical Considerations

Passengers with medical conditions, disabilities, or special needs must inform Playenda at time of booking. Pregnant passengers and those with mobility limitations should consult with medical professionals before booking.

8. Environmental Responsibility

All passengers must comply with environmental regulations and our Green Waters sustainability policies, including:

• No disposal of waste materials overboard
• Respect for marine wildlife and habitats
• Compliance with no-discharge zones and marine protected areas

9. Charter Modifications

Playenda reserves the right to modify charter routes, duration, or vessel assignment due to weather, mechanical issues, or safety concerns. Such modifications do not constitute grounds for refund unless the charter is significantly shortened.

10. Privacy and Data Protection

Personal information collected during booking is used solely for charter services and is protected according to our Privacy Policy. We do not sell or share personal information with third parties except as required by law.

11. Dispute Resolution

Any disputes arising from charter services will be resolved through binding arbitration in Toronto, Ontario, under Canadian maritime law. Both parties agree to attempt mediation before pursuing arbitration.

12. Force Majeure

Playenda is not liable for delays or cancellations due to circumstances beyond our control, including but not limited to natural disasters, government actions, labor disputes, or public health emergencies.

13. Intellectual Property

All content, logos, and materials associated with Playenda services are protected by copyright and trademark laws. Passengers may not use our intellectual property without written permission.

14. Governing Law

These terms are governed by the laws of Ontario, Canada, and any disputes will be subject to the exclusive jurisdiction of Ontario courts.

15. Modifications to Terms

Playenda reserves the right to modify these terms at any time. Continued use of our services after modifications constitutes acceptance of the updated terms.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
